Tube driver in strike row wins
A Tube driver has won his tribunal case at the centre of a sacking row LED Tube which has led to two weeks of strike action on London Underground (LU) in May and June.The employment tribunal ruled that LU employee Eamonn Lynch – who was sacked for breaching safety rules – was unfairly dismissed.The Rail, Maritime and Transport union (RMT), which has planned six days of walkouts over the sacking, has now called for urgent meetings with bosses at Transport for London (TfL).The RMT has alleged that both Lynch and fellow driver Arwyn Thomas – who TfL dismissed for “unacceptable and abusive behaviour towards colleagues” – were unfairly sacked because of their trade union activities.
Thomas’s tribunal case is yet to conclude, and TfL has insisted negotiation LED Tube talks cannot be held while proceedings are still underway. The company said it would be “carefully considering its next steps” following the Lynch ruling, but urged the union to withdraw its mass strike action threat over individual cases.LU managing director Mike Brown said: “As we have always said, disputes involving individuals should be dealt with through the mechanisms established for that purpose.”He added: “While the tribunal has made a finding of unfair dismissal, it has also found that Mr Lynch breached an established and significant safety rule and was in part culpable or blameworthy for his actions.”RMT general secretary Bob Crow said: “There is now an urgent need for London Underground to meet with the RMT to set out a plan for a return to work that can avoid plunging London into two blocks of strike action that everyone knows will lead to massive disruption.”London Mayor Boris Johnson is currently urging MPs to back a change in the law on union strike votes, after only 29 per cent of the RMT drivers balloted backed the forthcoming industrial action.
The Tube strikes will begin on 16 May at 9pm and run until midday on 17 May. The next stoppage LED Tube that week lasts from noon on 18 May to noon on 19 May, followed by a 9-hour strike from 12pm on 20 May.The June walkouts are planned for between 9pm on 13 June and noon on 14 June,Phone Jammer, between midday on 15 June and midday on 16 June, and between 12pm on 17 June and 9pm the same day.The RMT is also set to ballot Jubilee line drivers for industrial action over changes to safety procedures, plus cleaners employed by outsourcer Mitie on First Great Western routes, in a dispute over pay.
